The objective of this article is to identify the legal discourses that are present in the superior courts jurisprudence regarding the modification of the civil registry by transgender people. This is a case-by-case qualitative analysis divided in two phases. In the first phase, the ADI 4.275 / DF judged by the Federal Supreme Court is analyzed. In the second phase, cases from the Superior Court of Justice were researched. From the obtained data, it was possible to identify three types of discourses on the subject: the essentialist, the supervisory and the emancipatory. In all speeches, the transgender person has the subjective right to change its name and gender in the civil registry. However, the requirements for the recognition of this right are different, varying according to the speech adopted. In the essentialist discourse, transsexuality is seen as a pathology that must be proven through a medical report. In the supervisory speech, the transgender person needs to prove fully its legal situation through a process in the Justice. In the emancipatory discourse, the Justice recognizes the free development of the gender identity of the individuals who perceive themselves as transgenders, and so they can administratively change their civil registry with just a manifestation of their will, without medical or judicial interference.
